This “Privacy Policy” describes the privacy practices of Mark43, Inc. and our subsidiaries and affiliates (collectively, “Mark43”, “we”, “us”, or “our”) and how we process personal information that we collect through our digital properties that link to this Privacy Policy, including our website www.mark43.com, mobile applications, social media pages, marketing activities, live events and other activities, and any other website or mobile application that we own or control and which posts or links to this Privacy Policy (collectively, the “Service”).
Mark43 provides a platform and suite of tools for public safety. This Privacy Policy does not apply to information that we process on behalf of our business customers (such as businesses and other organizations) while providing the Mark43 platform and services to them. Our use of information that we process on behalf of our business customers may be governed by our agreements with such customers. If you have concerns regarding your personal information that we process on behalf of a business customer, please direct your concerns to that customer.
Our websites, products and services are designed for our business customers and their representatives. We do not offer products or services for use by individuals for their personal, family or household purposes. Accordingly, we treat all personal information we collect as pertaining to individuals in their capacities as business representatives and not their individual capacities.

Personal Information We Collect
Information you provide to us. Personal information you may provide to us through the Service or otherwise includes:
- Business and personal contact information, such as your first and last name, email and mailing addresses, phone number, professional title and company name.
- Content you choose to upload to the Service, such as text, images, audio, and video, along with the metadata associated with the files you upload.
- Profile information, such as your username and password that you may set to establish an online account with us, biographical details, your photograph, interests, and preferences, and any other information that you add to your account profile.
- Registration information, such as information that may be related to a service, an account or an event you register for.
- Communications data, based on our exchanges with you, including when you contact us through the Service, communicate with us via chat features, social media, or otherwise.
- Demographic Information, such as your city, state, country of residence, postal code, and age.
- Precise geolocation information, such as when you authorize our mobile application to access your location.
- Transaction information, such as information relating to or needed to complete your orders on or through the Service and other details of products or services you have purchased from us, including order numbers and transaction history.
- Survey data, and any information you share when you complete a survey.
- User-generated content, such as photos, images, comments, questions, messages, works of authorship, and other content or information that you generate, transmit, or otherwise make available on the Service, as well as associated metadata. Metadata includes information on how, when, where and by whom a piece of content was collected and how that content has been formatted or edited. Metadata also includes information that users can add or can have added to their content, such as keywords, geographical or location information, and other similar data.
- Job application data, such as professional credentials and skills, educational and work history, LinkedIn profile page, personal website, authorization to work in the U.S., immigration status, criminal history, and other information that may be included on a resume or curriculum vitae as well as in a cover letter. This may also include diversity information that you voluntarily provide.
- Marketing information, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications.
- Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.
Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:
- Public sources, such as government agencies, public records, job boards, social media platforms, and other publicly available sources.
- Private sources, such as recruiting agencies, job boards, data providers, social media platforms and data licensors.
- Partners, such as sales partners, joint marketing partners, and event co-sponsors.
- Business customers.
- Third-party services, such as social media services, that you use to log into, or otherwise link to, your Service account. This data may include your username, profile picture and other information associated with your account on that third-party service that is made available to us based on your account settings on that service.
Cookies and Other Information Collected by Automated Means
We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:
- Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
- Location data when you authorize (our mobile application/the Service) to access your device’s location.
- Communication interaction data such as your interactions with our email, text or other communications (e.g., whether you open and/or forward emails) – we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our emails.
Cookies and similar technologies. Some of our automatic data collection is facilitated by the following technologies.
- Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place.
- Local storage technologies, like HTML Web Storage, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
- Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
- Session-replay technologies, such as those provided by LogRocket that employ software code to record users’ interactions with the Services in a manner that allows us to watch video replays of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements, scrolls and keystrokes/key touches during those sessions. - Chat technologies, such as those provided by LiveChat that employ cookies and software code to operate the chat features that you can use to communicate with us through the Service. LiveChat and other third parties may access and use information about webpages visited on our website, your IP address, your general geographic information (e.g., city, state), and other personal information you share through online chats for the purposes described in this Privacy Policy.

Referrals
Users of the Service may have the opportunity to refer friends or other contacts to us. If you are an existing user, you may only submit a referral if you have permission to provide the referral’s contact information to us so that we may contact them.
How We Use Your Personal Information
We use your personal information for the following purposes and as otherwise described in this Privacy Policy or at the time of collection:

Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Service, our communications and other online services over time, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms. - Testimonials. We may use your feedback to post comments about your experience with any Service on the website, in our marketing and promotional materials.
Service improvement and analytics. We may use your personal information to analyze your usage of the Service, improve the Service, improve the rest of our business, help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails, and to develop new products and services.

To manage our recruiting and process employment applications. We may use personal information, such as information submitted to us in a job application, to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, and monitoring recruitment statistics.
To create anonymous, aggregated or de-identified data. We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.
Retention. We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.
How We Share Your Personal Information
We do not share your personal information with third parties without your consent, except in the following circumstances or as described in this Privacy Policy:
Affiliates. We may share your personal information with our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.
Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate the Service (such as customer support, hosting, analytics, email delivery, marketing, online chat functionality providers, and database management services). These third parties may use your personal information only as directed or authorized by us and in a manner consistent with this Privacy Policy, and are prohibited from using or disclosing your information for any other purpose.
Survey Partners. We use a third party, Sprig, to create and administer surveys that appear on our website. Should you choose to respond to a survey, information you enter is shared and stored with Sprig. Sprig also collects information about your interaction with each survey, such as usage, device, and referral data. Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so. For example, we may share your personal information with third-party advertisers with whom we are collaborating to offer you additional services such as sweepstakes, raffles, and promotions. We will share personal information that is needed for these other companies to provide the services that you have requested.
Business and marketing partners. Third parties with whom we co-sponsor events or promotions, with whom we jointly offer products or services, or whose products or services may be of interest to you.
Linked third-party services. If you log into the Service with, or otherwise link your Service account to, a social media or other third-party service, we may share your personal information with that third-party service. The third party’s use of the shared information will be governed by its privacy policy and the settings associated with your account with the third-party service.
Linked third-party services and social media networks. If you have enabled features or functionality that connect the Service to a third-party platform or social media network (such as by logging in to the Service using your account with the third-party, providing your API key or similar access token for the Service to a third-party, or otherwise linking your account with the Service to a third-party’s services), we may share your personal information with that third-party service. The third party’s use of the shared information will be governed by its privacy policy and the settings associated with your account with the third-party service.
Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.
For compliance, fraud prevention and safety. We may share your personal information for the compliance, fraud prevention and safety purposes described above.
Business transfers. We may disclose personal information in the context of actual or prospective business transactions (e.g. investments in Mark43, financing of Mark43, public stock offerings, or the sale, transfer or merger of all or part of our business, assets or shares), for example, we may need to share certain personal information with prospective counterparties and their advisers. We may also disclose your personal information to an acquirer, successor, or assignee of Mark43 as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets.
Other users and the public. If you provide a testimonial that is intended to be public, we may disclose your information to other users and the public. This information can be seen, collected and used by others, including by being cached, copied, screen captured or stored elsewhere by others (for example, search engines) and we are not responsible for any such use of this information.
Your Choices

Access or Update Your Information. If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.
Opt out of communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email. You may continue to receive service-related and other non-marketing emails.
Cookies & Browser Web Storage. We may allow service providers and other third parties to use cookies and similar technologies to track your browsing activity over time and across the Service and third party websites. For more details, see our Cookie Policy.
Blocking images/clear gifs: Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.
Location data. Users of our mobile application also have the choice whether to allow us to access your precise location data. You can disable our access to your device’s precise location data in your mobile device settings. Please note that disabling location data may prevent certain services, such as our OnScene product, from operating properly.
Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.
Choosing not to share your personal information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.
Delete your content or close your account. You can choose to delete certain content through your account. If you wish to request to close your account, please contact us.
Other Sites, Mobile Applications and Services
The Service may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. Security Practices
The security of your personal information is important to us. We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.
International Data Transfers
We are headquartered in the United States and have service providers in other countries, and your personal information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those in your state, province, or country.

Children
The Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.
Changes to this Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. We may, and if required by law will, also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail (if you have an account where we have your contact information) or another manner through the Service.
Any modifications to this Privacy Policy will be effective upon our posting the new terms and/or upon implementation of the new changes on the Service (or as otherwise indicated at the time of posting). Notice to European Users
Overview. Mark43 operates within the United Kingdom (UK). As such, we have a legal responsibility to comply with the UK version of the General Data Protection Regulation (UK GDPR) and Data Protection Act 18 (DPA 18). One of the requirements of the UK GDPR is to provide individuals with information on how Mark43 uses personal data. In addition to what we have laid out above, this privacy notice aims to meet that legal requirement.
This section uses terminology that is defined in the UK GDPR. ‘We’ or ‘us’ refers to Mark43, Inc., our subsidiaries and affiliates.
Purpose of Processing and Lawful Basis. Mark43 may use your personal data for a variety of purposes. Below is a list of the processing activities that occur on a regular or frequent basis. The brackets indicate the most applicable UK-GDPR Article 6 lawful basis that Mark43 relies on for this processing activity. Not all processing activities will apply to all individuals. The sub-headings and descriptions for each section are indicative (not exhaustive) of the types of individual whose data may be used in the processing activities.
- Recruitment Activities. This section applies to any individual who participates in Mark43’s recruitment activities.
- Recruitment (Contract) – Recruitment of new employees, including the collection of CVs, interviews, and job offers.
- Basic Right to Work Checks (Legal Obligation) – Performing basic personnel security screening including, eVerify, visa checks, & right to work.
- Sales & Marketing Activities. This section applies to potential Mark43 Customers, Sales Partners, and individuals who have shown interest in our Marketing activities.
- Inbound Sales inquiries (Phone, Email, Live Chat) (Legitimate Interests) – Management of personal data associated with inbound inquiries to Mark43’s company phone number, voicemail service, email, live website chat, and Police1. This includes contact data for potential customers who request a call or email back via website forms.
- Exhibiting at Events (Legitimate Interests) – The collecting of sales prospect data (and related data) at live or virtual events that Mark43 have exhibited at.
- Hosting of Events (Legitimate Interests) – Records of events that Mark43 have hosted. This includes both in-person events and virtual events.
- Email Marketing (Legitimate Interests) – Management of email marketing campaigns.
- Gated Content (Legitimate Interests) – The use of gated content to collect contact information from individuals who have shown interest in Mark43 marketing material. This gated content can be hosted by Mark43 or by third parties.
- Public Relations (Consent) – Keeping records of quotes that Mark43 customers have stated about our product and services for the purposes of Public Relations. This process also involves keeping records of video recordings of customers too.
- Sales Pursuit, Opportunity Management & Account Management (Legitimate Interests) – The tracking of potential customer sales journeys, including automated reminders, follow up sales calls, demonstrations, related activities. This also includes management of customer relationships including meeting notes, meeting recordings, and customer tracking.
- Contract Processing (Legitimate Interests) – Management of personal data associated with customer contracts. This includes contract renewals.

- Website Cookies (Non-Essential) (Consent) – The use of non-essential website cookies and related data on the Mark43 website & Help Centre. Non-essential cookies are used for tracking, statistics and marketing purposes.
Transfers of Personal Data. As part of Mark43’s standard business operations, we will transfer your personal data to other Mark43 subsidiaries. We may also transfer your personal data to third parties. Depending on the third party that data is transferred to, your information may be sent outside of the UK. In these instances, Mark43 will ensure that the appropriate safeguards have been applied to this transfer of data, including insuring that any relevant contracts are UK-GDPR complaint.

Most third parties that Mark43 uses are based in the USA. The appropriate safeguard that we use to protect your data are international data transfer agreements (IDTAs) or standard contractual clauses (SCCs). If you need more specific information on these transfers, please contact us.
Retention Periods. Mark43 has set retention schedules which state how long we will keep personal data for. The majority of our data processing activities fall within the below categories; however, for some less frequent data processing activities we may have different retention schedules set. For more information on these other retention schedules, please contact us.
- Default Retention Schedule – For data which does not fit into another category, data is kept for 8 years after the data entry was created, at which point it is reviewed for further retention, deletion, or archiving.
- Recruitment Activities. This section applies to any individual who participates in Mark43’s recruitment activities.
- Unsuccessful Recruitment Candidate Data – For any personal data relating to job applicants who were unsuccessful (e.g. CVs, interview notes, etc.) data is kept for 1 year after the last action, at which point, data is deleted.
- Sales & Marketing Activities. This section applies to potential Mark43 Customers, Sales Partners, and individuals who have shown interest in our Marketing activities.
- Sales Prospect Data – For any data relating to a potential sales prospects and the conversation/meeting histories with those prospects, data is held for 4 years after the point of last contact, at which point, data is deleted.
- Customer Proposals, Contracting & Bidding Material – For any basic contact data relating to a current or previous customer and any data relating to contract negotiations, statements of work, bid materials, meeting notes, etc., data is kept for 6-10 years (dependent on country/state) after the end of the contract, at which point, personal data is deleted or made anonymous.
- Suppliers, Sales Partners, & Other Third Party Management. This section applies to individuals who work for Mark43 Suppliers, Sales Partners and other third parties.
- Financial Data – For any financial related data such as payroll data, pension data, tax records, invoices, etc., data is kept for 7 years after the end of the financial year, at which point, data is deleted.
- Compliance Audits – Any personal data related to compliance audits that Mark43 undertakes (e.g. organisational charts, governance data) is kept for 10 years after the end of the audit date, at which point, data is deleted.
- Vendor Contracting Material – For any data that relates to third party vendor contracting due diligence or related material, data is kept for 7 years after the end of the contract, at which point, data is deleted.
- Sales Prospect Data – For any data relating to a potential sales prospects and the conversation/meeting histories with those prospects, data is held for 4 years after the point of last contact, at which point, data is deleted.
- Customer Proposals, Contracting & Bidding Material – For any basic contact data relating to a current or previous customer and any data relating to contract negotiations, statements of work, bid materials, meeting notes, etc., data is kept for 6-10 years (dependent on country/state) after the end of the contract, at which point, personal data is deleted or made anonymous.
- Other
- Incident Logs – For any data relating to an information security incident, data is held for 10 years after the date of last action, at which point, the data is reviewed for further retention or is deleted.
- Third Party Website Cookies – Please see the Mark43 cookie management system for details on the retention schedule of specific cookies.
Mark43 employs a retention schedule +1 system for management of data. We will keep data for the stated duration and then review data for deletion during an annual review of all data at some point during the following year.
Your UK GDPR Rights. Under the UK GDPR, you have rights that you may exercise at any time. Whilst you may exercise these rights at any time, Mark43 is not always obliged to comply with your requests. Each right has requirements and exemptions that are associated with them. - The Right to be Informed – You have the right to be informed about how Mark43 uses your personal data. We are required to provide you with details of our data processing activities (where they involve your personal data). - The Right of Access – You have the right to request a copy of the personal data that Mark43 holds about you.
- The Right to Rectification – If Mark43 holds personal data about you that is inaccurate or outdated, you have the right to request that this information is changed.
- The Right to Erasure – You have the right to request that Mark43 deletes personal data that relates to you.
- The Right to Restrict Processing – You have the right to request that Mark43 restricts or suppresses the further processing of your personal data.
- The Right to Data Portability – You have the right to request that Mark43 provide a copy of your personal data to you in a commonly used digital format.
- The Right to Object – You have the right to object to specific processing activities that Mark43 undertakes. Specifically, you may object if Mark43 is using your data form marketing purposes, for a task carried out in the public interest, for an exercise of official authority, or where we have relied on legitimate interests as a lawful basis.
- Rights in Relation to Automated Decision-Making Including Profiling – Where Mark43 uses IT systems to make decisions about you (with no human involvement or oversight), you have UK GDPR rights in relation to this. These rights include the ability to request for human intervention to challenge a computer made decision, or to request a check that an automated system is working as intended. Currently, Mark43 does not carry out any automated decision making or profiling.
The Right to Withdraw Consent. Where Mark43 has relied on consent as a UK GDPR Article 6 lawful basis or an Article 9 exemption, you have the right to withdraw this consent at any time. When you withdraw your consent for data processing, Mark43 will make reasonable efforts to stop the associated processing activity as soon as possible.
